Dear Owners,
With this correspondence the Board of Directors hopes to address some concerns regarding ACC requests and violations within the community.
Effective immediately, owners submitting an ACC request will no longer be required to pay the $10 review fee. In reviewing the covenants, the Board has determined there is no need for this fee as the review committee is comprised of Board selected volunteers. The Board asks that all owners making any exterior modifications to their home submit an ACC request and wait for approval prior to making any alterations.
Trees and landscaping installed by homeowners in the courtyards have become a major area of concern for the Board. There are a few items which were installed by homeowners prior to the establishment of the Board of Directors which are retroactively not allowed by the governing documents. Such items will not be allowed moving forward, but due to Georgia Statue 9-3-39 those owners are grandfathered in and protected from Board mandated removal. Regardless, as stated above, owners must submit an ACC request for all exterior modifications. Let it be understood: the few owners who have been grandfathered do not set a precedent for future requests.
The Board also wants to inform owners that, as of June 2023, Tolley Community Management has been authorized to perform monthly violation inspections. The management office will be following the covenants along with the rules and regulations when issuing violations. If you receive a violation notice, please log into your online account to monitor the matter under the “Violations” heading. The portal will allow you to note when resolution can be expected and submit photographic support as confirmation once the issue has been resolved. You are welcome to contact the management office, but all communications must be submitted in writing in order to close or place a hold on any violation. The Board wants to thank all owners for complying with the covenants of our community. It helps all of us when the neighborhood is so well maintained.
